Charges sought in ATV crash

Requests for charges from an all-terrain vehicle injury accident early this summer near Geneva were given to Allen County Attorney Jerry Hathaway today.
Jeffrey Fullerton, 20, and Brandon Ellington, 19, both of Yates Center, were injured early the morning of June 7. Allen County deputies, who happened on to the accident while responding to another call, said Fullerton had stopped his ATV on a hard-surfaced road south of Geneva Cemetery and was waiting for Ellington, also on an ATV, to catch up.
Fullerton’s taillights were not on and Ellington, his speed estimated at 30 to 40 miles an hour, did not see Fullerton’s machine until it was too late to stop. Both were ejected. Fullerton sustained minor injuries and Ellington was taken to Allen County Hospital, where he was treated and released.
Officers said charges of driving while under the influence of drugs or alcohol, minor in consumption of alcohol and violation of a county resolution regarding the operation of ATVs were requested against both. An additional charge of parking or stopping without lights was requested against Fullerton.
